Terms of Service

1. Acceptance of terms

By downloading, installing, or using AllerGuide ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

AllerGuide is operated by Benedetto Colella ("we", "us", "our"). Questions about these Terms can be sent to benedettoc2004@icloud.com.

2. Who can use AllerGuide

You must be at least 13 years old to use AllerGuide. If you are under 18, you must have permission from a parent or guardian. By using the App, you confirm that you meet these requirements.

3. The service

AllerGuide provides:

• A database of dishes from global cuisines with allergen information
• Personalised allergen filtering based on your profile
• An AI-powered chat for ingredient and allergen questions
• The ability to save dishes and allergy communication phrases

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice of material changes where possible.

4. Medical and safety disclaimer

AllerGuide is designed as an informational guide to help you make more informed choices when travelling and eating out. It is not a medical device, medical application, or substitute for professional medical advice.

• Allergen information in the App is based on typical recipes and may not reflect how a specific dish was prepared in a specific restaurant on a specific day.
• Cross-contamination, substituted ingredients, and regional variations can all affect allergen content in ways the App cannot detect.
• The AI Chat feature provides general information only. Its responses may be inaccurate, incomplete, or not applicable to your specific situation.
• AllerGuide does not replace consultation with a qualified allergist, physician, or dietitian.

By using AllerGuide, you acknowledge and accept these limitations. You are solely responsible for verifying the safety of any food you consume.

5. Your account

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at benedettoc2004@icloud.com if you suspect unauthorised access.

You may delete your account at any time from within the App or by contacting us. Upon deletion, your personal data will be permanently removed within 30 days.

6. Subscriptions and payments

AllerGuide offers a free tier and a Pro subscription ("AllerGuide Pro"). The Pro subscription unlocks additional features including saved phrases and enhanced AI chat.

• Subscriptions are billed monthly or annually as selected at purchase.
• Payment is processed through Apple's App Store. Your purchase is subject to Apple's payment terms.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage and cancel your subscription in your iPhone's Settings → Apple ID → Subscriptions.
• We do not offer refunds outside of what Apple's standard refund policy provides. To request a refund, contact Apple directly.

We reserve the right to change subscription pricing. We will give at least 30 days' notice of any price increases.

7. Acceptable use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract the source code of the App
• Use automated tools to scrape, crawl, or extract data from the App
• Attempt to circumvent any security features or access controls
• Submit false, misleading, or harmful content
• Use the App in any way that could damage, disable, or impair its operation

8. Intellectual property

All content in AllerGuide — including but not limited to the app design, dish data, text, graphics, and AI-generated content — is owned by or licensed to Benedetto Colella. You may not reproduce, distribute, or create derivative works from any part of the App without our express written permission.

You retain ownership of any content you create (such as your allergen profile). By using the App, you grant us a limited licence to store and process that content solely to provide the service.

9. Privacy

Our Privacy Policy describes how we collect, use, and protect your data. It forms part of these Terms. By using AllerGuide, you also agree to the Privacy Policy.

10. Limitation of liability

To the maximum extent permitted by applicable law:

• AllerGuide is provided "as is" without warranties of any kind, express or implied.
• We do not warrant that allergen information in the App is accurate, complete, or up to date.
• We are not liable for any allergic reaction, injury, illness, or harm arising from reliance on information provided by AllerGuide.
• Our total liability to you for any claim arising from these Terms or use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or £50, whichever is less.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the minimum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless Benedetto Colella from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where required otherwise by applicable consumer protection laws in your country of residence.

13. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes via the App or by email. Continued use of AllerGuide after changes take effect constitutes your acceptance of the updated Terms.
